Section 61 
1. The relative severity of dissimilar principal punishments shall be determined in the order in which 
they are set out in section 9. 
2.  In cases where the court may, at its discretion, choose between two principal punishments, only the 
more severe of these two punishments shall serve as a criterion for this comparison.  
3.  The relative severity of similar principal punishments shall be determined by the maximum term of 
each of these punishments. 
4.  The relative length of both dissimilar and similar principal punishments shall also be determined by 
the maximum term of each of these punishments.
