Section 389bis 
1.  A master 
of a Dutch vessel who has a ship’s protest prepared, knowing that its contents are false, 
shall be liable to a term of imprisonment not exceeding four years or a fine of the fourth category. 
2.   
Crew members who cooperate in the preparation of a ship’s protest, knowing that its contents are 
false, shall be liable to a term of imprisonment not exceeding two years or a fine of the fourth 
category. 
Section 389ter 
Any person who, for the purpose of compliance with requirement of section 8:194(4), section 8:784(5), 
section 8:786(1)( a)(3°) or section 8:1303(4) of the Civil Code, submits a written statement, knowing 
that its contents are false, shall be liable to a term of imprisonment not exceeding four years or a fine

Section 390 
A master of a Dutch vessel who, during the voyage, intentionally removes himself from command 
shall, if such behaviour endangers the safety of the persons on board, of the vessel or of the property 
on board, be liable to a term of imprisonment not exceeding one year or a fine of the third category.
