Section 312 
1.  Theft preceded, accompanied or followed by an act of violence or the threat of violence against 
persons, committed with the intention of preparing or facilitating that theft or in the event of being 
caught in the commission of the serious offence to secure for himself or the other participants in 
that offence either escape or possession of the stolen property, shall be liable to a term of 
imprisonment not exceeding nine years or a fine of the fifth category.  
2.   A term of imprisonment not exceeding twelve years or a fine of the fifth category shall be imposed:  
1°.  if the offence is committed either during the night-time, in a dwelling or on enclosed premises 
containing a dwelling, or on a public road, or in a moving railroad train;  
2°.  if the offence is jointly committed by two or more persons;  
3°.  if the offender has gained access to the place where the serious offence is committed by 
means of forcible entry or climbing in, by means of false keys, a false order or a false uniform;  
4°.  if the offence results in grievous bodily harm; 
5°.  if the offence is committed with the intention of preparing or facilitating a terrorist offence. 
 
3.   A term of imprisonment not exceeding fifteen years or a fine of the fifth category shall be imposed, 
if the offence results in death.

Section 313 
In the case of conviction for theft, disqualification from the rights listed in section 28(1)(1°),( 2°) and 
(4°) may be imposed.
