CITY COUNCIL MEETING

July 10, 1967


The Orem City Council met in regular session on Monday, July 10, 1967, at 7:00 p.m. in the Council Chambers. Present were James E. Mangum, Chairman; Councilmen Harley Gillman, Paul Washburn, Ellis Rasmussen, Stanley Leavitt, and Dixon Larson; City Manager Earl Wengreen, Engineer Russell Brown, BYU Intern Raeldon Barker, Recorder Anne Cooper.

Meeting opened with prayer by Stanley Leavitt.
Motion was made by Ellis Rasmussen, seconded by Stanley Leavitt to approve the minutes of July 3, 1967, and the continuation of July 3, 1967, meeting held July 6, 1967, as read and corrected. Motion passed unanimously.
City Manager Wengreen read the following letter from the Utah Power and Light Company from Marden R. Millward:

Dear Mr. Wengreen:
Effective July 9, 1967, there will be a rate reduction on the following mercury vapor lights installed within the corporate limits of Orem City:

It is most gratifying to report that as a result of this rate reduction, there will be a savings to Orem City of $181.35 per month or $2,176.20 per year.
I would be most happy to meet with you at your convenience to discuss the possibilities of installing additional street lighting in your city.

Motion was made by Paul Washburn to authorize the City Manager to make a study regarding increasing street lighting as recommended by Utah Power and Light Company. Motion was seconded by Harley Gillman and passed unanimously.
Fay R. Johnson, President of Orem Boosters, reported that the Summer Festival plans are going well. There have been over $600 worth of tickets to the Musical sold. Costs for the musical will not be much this year as expensive Royalty Rights are not required. Also, other costs are lower.
Mr. Johnson stated that a special vote of thanks should be extended to Mr. and Mrs. Elison for the time spent at rehearsal of the Musical. Mr. Elison is director, and doing a fine job.
Mayor Mangum commended Mr. Johnson because not only does he have a program that costs less dollar wise, but is public spirited as well.
Mayor Mangum read a letter from the Central Utah Water Conservancy District as follows:

Dear Mayor Mangum:
Construction is now well under way on the office building of the Central Utah Water Conservancy District at 350 West 1300 South in Orem. It is anticipated that the building will be ready for occupancy by the end of this year.
Since the main access to the property is planned to be by way of 400 West from 1300 South, it be­comes increasingly important that 400 West between 13th and 14th South be opened up as a city street. In our previous discussion with the City Council and City Manager, it was more or less under­stood that when the time came 400 West would be opened up. The Central Utah Water Conservancy District hereby requests that action be taken at the earliest possible date to open 400 West to traffic, and if possible to also extend 1400 South to intersect 400 West.
The District will appreciate your prompt consideration and action in this matter.

Motion was made by Harley Gillman to authorize the City Engineer to make a study regarding the request of the Central Utah Water Conservancy District and bring his recommendations to the next Council meeting. The motion was seconded by Ellis Rasmussen and passed unanimously.
Mayor Mangum turned the meeting to Mayor Pro Tem Dixon Larson at 8:00 p.m., and asked to be excused.
Mayor Pro Tem Dixon Larson reported that the Committee on Beer and Cabaret Licenses had contacted the Municipal League for data regarding the number of taverns allowed per capita in other cities. Orem City has less taverns per capita than Ogden and some other cities. The committee recommended setting up legislation so the City could examine premises before a new license is issued, and before renewing licenses.
The City Attorney was asked to prepare an outline of the extent to which a City can regulate establishments selling beer and set ups.
Ellis Rasmussen presented an Orem City Employee Education Program as recommended by the Committee, as follows:
OREM CITY EMPLOYEE EDUCATION PROGRAM
As an incentive to employees who desire to improve their quality of service, their capabilities and potentials and in recognition of the desirability of upgrading the technical and professional levels of employees who desire such improvement, the following educational program is offered in Orem City:

  1. Such courses as are pertinent in the employees' needs and are available at Brigham Young University, Utah Trade Technical College, or in the adult education programs of Alpine School District at times and places available to the individuals desiring them may be approved.




  1. The City will pay the cost of tuition and books for any employee qualifying under the program, up to a maximum of $50.00 per year for any one employee.




  1. Reimbursement will, however, only be made for such classes as the City Council deems to be conducive to direct and desirable improvement of the employee's capabilities in service, prior approval having been given by the Department Head, Councilmen, and City Manager.




  1. All training under this program shall be on the employees own time.




  1. The employee must receive a passing grade in the course in order to qualify for the reimbursement.




  1. All employees taking such training with such reimbursement of fees and book costs must stay with the City at least 12 months after receiving training otherwise the reimbursement will be forfeited or must be returned.

Item No. 2 was amended to read "up to a maximum of $50.00 per year for any one employee", instead of $100.00 as originally proposed.


It was recommended that item #3 be amended to specify that reimbursement for cost of tuition and books would be contingent upon prior approval having been given by the department head, City Manager and a Councilman selected by Council.
Also, item #7 was eliminated. (Effect of such training on the employees wage or salary scale:)
Motion was made by Stanley Leavitt to approve the Orem City Employee Education Program as amended. Motion was seconded by Paul Washburn. Voting aye: Ellis Rasmussen, Paul Washburn, and Stanley Leavitt. Voting nay: Harley Gillman. Motion passed by a majority vote.
Dixon Larson also reported the Committee felt the employee should not take time off to take a class and then make the time up.
Stanley Leavitt was excused at 8:15 p.m.
Donald Shaw, Senior Citizen's Chairman reported that the Senior Citizen's have been asked to prepare a parade entry, and will have a surrey with mares, pioneer style.
Mr. Shaw stated that he has placed a BYU student on Senior Citizen Project. One student is preparing a list of all the Senior Citizen's with names, addresses, and telephone numbers. Then questionnaires will be sent out to these people to find out what kind of organization they want, what recreation they would desire, and if they want to take part in Community service. Also, if they want a center in Orem or to go to the Eldred.
Another student is finding out what Government funds are available to develop a Senior Citizen's Program.
The Council expressed appreciation for Mr. Shaw's service.
Arnold Long reported on the Arson Seminar which he, and Byron Penrod, Police Sergeant, attended at Riverside, California.
Ephrim Twitchell reported on the Refuse Equipment conference which he attended in San Francisco, California. Orem City is ahead of San Francisco in the train system, but behind on the landfill method of disposal of garbage.
Rock Canyon Ditch Co. officials met to discuss sale of irrigation water to Orem City.
The Council advised the representatives to present their offer to the Metropolitan Water Board, July 20, 1967.
Russell Brown, City Engineer, reported that Well No. 2 is back in operation, running well, and has no problem with sand since upper perforations were sealed off.
Mr. Brown reported that he presented invoices to the Metropolitan Water Board for payment for improving Well No. 2; however, the Metropolitan Water Board wanted to know if the City would pay direct since we are in the new budget year.
Motion was made by Harley Gillman to authorize payment of the invoices for repair of Well #2 as budgeted for 1967-68, totaling $4,181.20. Motion was seconded by Paul Washburn, and passed unanimously.
Motion was made by Harley Gillman to authorize the City Manager to contract with Burrows, Smith and Co., to act as fiscal agent on Special Improvement District #M. The motion was seconded by Ellis Rasmussen, and passed unanimously.
Russell Brown presented deeds for street right-of-ways for acceptance.
Motion to accept Quit Claim Deed from Deseret Federal was made by Harley Gillman, seconded by Ellis Rasmussen, and passed unanimously.
Motion to accept a Quit Claim deed from Frank Cordner was made by Paul Washburn, seconded by Harley Gillman, and passed unanimously.
Motion was made by Harley Gillman to accept a Warranty Deed from Walter Rieske to correct the shape of a cul-de-sac at 160 South 800 West, and issue a warranty deed to return property right-of-way deeded at a previous time to Mr. Rieske. Motion was seconded by Ellis Ras­mussen, and passed unanimously.
Motion was made by Harley Gillman to accept a Quit Claim Deed from E.L. Carter for right-of-way 1000 South east of 800 East. The motion was seconded by Paul Washburn and passed unanimously.
Motion was made by Harley Gillman to accept a Quit Claim Deed from McKendall Jolley for right-of-way on Main Street from 300 North to 400 North. The motion was seconded by Ellis Rasmussen, and passed unanimously.
Warren Bunting, Chairman of the Landscape Improvement Committee, invited the Mayor and Council to participate with them in painting the curb at the City Hall, and other projects Saturday, July 15th. Free lunch will be served to the workers from 11:00 a.m. to 1:00 p.m.
Motion to adjourn was made by Paul Washburn, seconded by Harley Gillman, and passed unani­mously.
