86. To exculpate itself the government used law-enforcement agencies (MIA, NSS, and General Prosecutor's Office) and courts to wage a war on dissent, persecuting human rights defenders, foreign and independent journalists, political activists, and the eyewitnesses of the massacre.
87. As a result of the persecution over 80 human rights defenders, independent journalists, and eyewitnesses of the event had to migrate to other countries. Twenty four human rights defenders and journalists were detained and sentenced under fabricated charges. During investigations they were subjected to torture and various kinds of pressure.
88. The efforts of the international community, the European Union, and the Embassy of Germany in Uzbekistan helped free the following people from prison: Mr. Ulugbek Khaydarov (born 1963), an independent journalist sentenced to 6 years of imprisonment, Ms. Umida Niyazova (born 1974), a human rights defender sentenced to 7 years of imprisonment, Ms. Gul'bakhor Turaeva (born 1966), a human rights defender sentenced to 8 years of imprisonment, and Mr. Yadigar Turlibekov (born 1936), a human rights defender sentenced to 3.5 years of imprisonment.
89. Endangered still are the lives of over 20 human rights defenders and political activists sentenced to long terms of imprisonment in Uzbek prisons. These people include Ms. Mutabar Tadjibaeva (born 1962), a well-known human rights defender from Fergana sentenced to 8 years in prison and Mr. Sanzhar Umarov (born 1956), the leader of Solnechnyi Uzbekistan Coalition sentenced to 7 years in prison. The health of these people is deteriorating as they are being subjected to various forms of pressure.
90. The persecution of Uzbekistan's human rights defenders by MIA and NSS officers is continually increasing and becoming more severe. Human rights defenders are placed under house arrests, threatened, attacked, illegally taken to militia offices, and subjected to pressure.
91. Ms. Elena Urlaeva (born 1957), a well-known human rights defender, member of Uzbekistan's Human Rights Alliance, was attacked by eight women in Tashkent on 4 January 2007. She was severely beaten, but law-enforcement agencies failed to investigate the attack. Earlier, between 2001 and 2004 Ms. Urlaeva was twice forcibly admitted to psychiatric wards in Tashkent, where she was kept for 3 to 4 months and forced to take illegal psychotropic substances.
92. Mr. Dzhamshid Karimov (born 1967), resident of Djizak (Djizak Oblast), an independent journalist and nephew of President Islam Karimov. His articles, critical of the regime, were published online, resulting in numerous attacks and beatings by MIA and NSS officers. On 12 September 2006 he was illegally detained by unidentified militia officers and forcibly taken to a psychiatric ward in Samarkand. Following that Djizak City Court ordered that it was "necessary to commit him to six months of compulsory medical treatment". After the term of treatment expired, it was illegally extended, and Mr. Karimov remains in the psychiatric facility.

to the Government of the Republic of Uzbekistan.
93. We recommend to enact a resolution to release and exonerate citizens of Uzbekistan and other countries who have been imprisoned for their religious beliefs, political activists, entrepreneurs, businesspeople, and human rights defenders sentenced as a result of fabricated criminal cases;
94. To review fabricated criminal cases against over 400 convicted "participants" in the Andijan events of 13 May 2005 who were tried in secret in Tashkent and Tashkent Oblast;
95. To establish a governmental committee in cooperation with non-governmental organization (NGOs) to investigate repressions and persecutions carried out on political and religious grounds and to prosecute the perpetrators of illegal arrests, torture, fabrication of criminal cases, those who pronounced clearly wrongful sentences and subjected convicts to torture;
96. To enact a resolution to reduce the number of staff in the Ministry of Internal Affairs, the National Security Service, and the Ministry of Defense while increasing the salaries of remaining officers;
97. To enact a resolution to increase the salaries of judges, prosecutors, and officers of tax and customs agencies, who currently receive 80 to 100 US Dollars per month on average;
98. To enact a special resolution of the Cabinet for MIA, NSS, General Prosecutor's Office and the Supreme Court to eradicate the use of torture, fabrication of criminal cases, influence on court decisions, and persecutions of religious people, human rights defenders, journalists, lawyers, and political activists while prosecuting those who violate the laws of Uzbekistan and ensuring relevant oversight under this resolution;
99. To assist the Oliy Mazhlis (Parliament) in adopting the Law on Agencies of Internal Affairs and on the National Security Service, which have been presented to the Oliy Mazhlis in 2001;
100. To improve supervision of MIA and NSS agencies and prosecutors' offices with regard to human rights violations and supervision of courts with regard to violations of the Code of Criminal Procedure and international law;
101. To build public awareness of the human rights situation in Uzbekistan through the mass media (television, radio, and newspapers) by producing programs covering violations of human rights, acts of torture, fabrication of criminal cases, and illegal trials;
102. To create conditions for conducting courses, workshops, and trainings on human rights for the officers of MIA, NSS, prosecutors' offices, and criminal judges in Uzbekistan;
103. To merge the investigative bodies of MIA, NSS and General Prosecutor's Office creating a National Committee for Investigations. This will help prevent interference of MIA and NSS agencies and prosecutors' offices in investigations, making it impossible to fabricate criminal cases.
104. To place Head Department of the Penitentiary (GUIN) under the jurisdiction of the Ministry of Justice of Uzbekistan.
105. To make uniforms compulsory for all MIA agencies, operative offices and authorities, investigation offices, ROVD, GOVD, GUVD, and oblast UVD (uniforms must be worn at all times while on duty).
106. To introduce labels with officers' names and numbers on the uniforms (jackets, suits, and shirts) of MIA and GUIN officers with the purpose of preventing abuses of power, torture, and illegal arrests, and to encourage conscientious service.
107. To prohibit detentions of religious people on suspicion of their involvement in religious movements by masked and armed MIA or NSS officers. (Sometimes to detain a mother of many children, a disabled or an elderly person up to 30 officers wearing masks and armed with firearms enter the house, scaring little children to the point of hysterics and making people faint).

to the Supreme Court of Uzbekistan to ensure:
108. Unimpeded access to open trials of the family and friends of the defendant and all those wishing to be present during the trial as observers;
109. Access by authorized attorneys and citizens with power of attorney to serve in defense of the defendant to trials and visits with their clients;
110. Judicial inquiries in response to acts of torture against defendants during detention and investigation;
111. The presence of a public prosecutor at all criminal trials;
112. Independent judiciary, fair trials, and inability of executive bodies to influence court decisions;
113. Professional development and training for judges, observance and enforcement of standards of international law in civil and criminal justice;
114. Careful consideration of citizens' pleas and complaints regarding court decisions, timely delivery of responses and decisions with the names of officials who reviewed these pleas and complaints to ensure that they can be prosecuted in the event of abuses;
115. To allocate one day each week for meetings with regular citizens by the Chief Justice of the Supreme Court;
to the Ministry of Internal Affairs of Uzbekistan:
116. To ensure professional development and training for all militia personnel (sergeants and officers) through courses, workshops and trainings to create awareness with regard to definitions of terms such as "torture", "human rights", and "international human rights conventions";
117. To stop persecutions of religious people, human rights defenders, journalists, lawyers, and political activists by officers of RUVD, GOVD, GUVD, oblast UVD, and MIA;
118. To discontinue the practice of MIA investigation bodies and their departments "pre-ordering" criminal cases and fabricating (falsifying) criminal cases against innocent people and against convicts who are nearing the end of their prison sentences;
119. To ensure prompt prosecution of officers involved in the use of torture, abuses of power, and fabrication of criminal cases;
120. To put an end to the practices of using torture against inmates in the GUIN system, not allowing inmates to pray or observe religious practices, or exerting pressure on inmates who are human rights defenders, journalists, or political activists;
121. To ensure proper living and social conditions for inmates as stipulated by the Code of Criminal Execution, Code of Criminal Procedure, and international law;

to the National Security Service of Uzbekistan:
122. To ensure continual oversight of NSS officers throughout the country with regard to possible abuses of office, extortions, and the use of torture and threats;
123. To put an end to the practice of fabricating criminal cases and reviewing cases that do not fall under the jurisdiction of NSS;
124. To enforce the Law on Citizens' Appeals, reviewing citizens' pleas and complaints, taking necessary measures, and providing timely and relevant responses to these please and complaints;
125. To combat bureaucracy and indifference to one's responsibilities among NSS officers on all levels;
126. To enforce common uniforms for all NSS officers on duty with their numbers displayed both on winter and summer uniforms to prevent possible abuses of power;
127. For relevant NSS decision-makers to schedule time daily for meetings with citizens;

128. To improve observance and enforcement of laws by MIA and NSS officers, prosecutors and criminal judges in the Republic of Uzbekistan;
129. To stop corruption, bribery, abuses of power, use of torture, fabrications and falsifications of criminal cases against innocent citizens;
130. To ensure that public prosecutors are present during all criminal trials;
131. To prevent illegally closed or secret criminal trials;
132. To ensure that criminal judges cannot be influenced by investigation and executive bodies when making decisions with regard to the defendant;
133. When making decisions with regard to authorization and approval of criminal cases, to make them responsibly and ensure that they are clear, to the point, and are based on facts and evidence;
134. To schedule weekly meetings with citizens by the General Prosecutor of the Republic of Uzbekistan;
135. When reviewing citizens' pleas and complaints, to ensure that they are based on facts and evidence with regard to the agency in question and to maintain accountability for relevant decisions and responses;
to the Oliy Mazhlis (the Parliament) of the Republic of Uzbekistan.
136. To ensure prompt enactment of the Law on Agencies of Internal Affairs and the Law on the National Security Service;
137. To enact laws that prevent attempts at persecution of religious people, political activists, human rights defenders, journalists, lawyers, and citizens claiming their constitutional rights;
138. To ensure that the Human Rights Commissioner (Ombudsman) of the Oliy Mazhlis duly reviews pleas and complaints submitted by citizens as stipulated by the Law on Citizens' Appeals.
