The City of Bradenton Code Enforcement Board met in regular session on July 21, 2015 at 2:30 P.M. in the City Hall Council Chambers, 101 Old Main Street, Bradenton, Florida.
ATTENDANCE
Code Enforcement Board members present:
Chairman Robert Grant, Al Youmans, Glyn Oldham, Xena Vallone, Brian Metrocavage and George Vojvodich.

Meeting called to order by Chairman Robert Grant at 2:31 P.M.

Pledge of Allegiance led by Mr. George Vojvodich.

Mr. Oldham made the motion to accept the minutes from June 16, 2015 as presented by staff. Second by Mr. Metrocavage. Motion carried 6-0.
WITNESSES SWORN IN:

Mr. Volker Reiss stated that Mr. Manley was unable to attend the hearing and asked if the case can be continued until the August 18, 2015 Code Enforcement Board Hearing.

Mr. Oldham moved to continue the case until the August 18, 2015 Code Enforcement Board Hearing. Second by Ms. Vallone. Motion carried 6-0.

Mr. Volker Reiss stated that Mr. Borababy has applied for some SHIP assistance and has been working on some of the violations and asked if the case can be continued until the November 17, 2015 Code Enforcement Board Hearing.
Actions
Mr. Metrocavage moved to continue the case until the November 17, 2015 Code Enforcement Board Hearing. Second by Ms. Vallone. Motion carried 6-0.
15-062 Deutsche Bank National Trust Company
Address: 6213 38th Avenue West
The property owner was not present. Jose Lebron, Code Enforcement Officer whose credentials are on file, entered six photographs into evidence. He displayed the photographs and explained the violations.
Actions
Mr. Oldham moved to find the property owner in violation of Sections 304.2, 304.6 and 302.7 from ordinance no. 2936. Second by Mr. Youmans. Motion carried 6-0.
Mr. Oldham moved to give the property owner 30 days for code compliance with a fine of $100.00/day thereafter. Second by Mr. Youmans. Motion carried 6-0.
15-063 William Matthew Serdyn

The property owner, William Matthew Serdyn, was present. Michael Maginness, Code Enforcement Officer whose credentials are on file, entered nine photographs into evidence. He displayed the photographs and explained the violations.
Mr. William Matthew Serdyn spoke about the violations and said he gave the house back to the bank.

Ms. Vallone moved to find the property owner in violation of Sections 302.7, 304.2, 304.10, 304.14, 304.7, 309.1, 308.1 and 302.4 from ordinance no. 2936, Chapter 5.0, Section 5.1.1 from the Land Use Regulations and Section 1 (A)(2)(3), Section 1 (B)(3) and Section 1 (B)(1) from ordinance no. 2821. Second by Mr. Oldham. Motion carried 6-0.
Ms. Vallone moved to give the property owner 30 days for code compliance with a fine of $200.00/day thereafter. Second by Mr. Oldham. Motion carried 6-0.

Mr. Volker Reiss stated that the owner is represented by attorney, Mark Barnabey who stated he was unable to attend the hearing and asked if the case can be continued until the August 18, 2015 Code Enforcement Board Hearing.

Mr. Youmans moved to continue the case until the August 18, 2015 Code Enforcement Board Hearing. Second by Mr. Metrocavage. Motion carried 6-0.

Mr. Metrocavage moved to find the property owner in violation of Section 1 (G)(1) from ordinance no. 2821. Second by Mr. Oldham. Motion carried 6-0.
Mr. Metrocavage moved to give the property owner 30 days for code compliance with a fine of $75.00/day thereafter. Second by Mr. Oldham. Motion carried 6-0.

Mr. Volker Reiss stated that the property is in compliance and the case is removed from the agenda.

The property owner’s representative, Bonnie Hunt, was present. Jermaine Agurs, Code Enforcement Officer whose credentials are on file, entered eight photographs into evidence. He displayed the photographs and explained the violations.
Ms. Bonnie Hunt, the property owner’s representative, spoke about the violations.

Mr. Youmans moved to find the property owner in violation of Sections 108.1.5.7, 304.2, 605.1, 304.1, 304.6 and 304.7 from ordinance no. 2936. Second by Mr. Oldham. Motion carried 6-0.
Mr. Youmans moved to give the property owner 120 days for code compliance with a fine of $150.00/day thereafter. Second by Mr. Oldham. Motion carried 6-0.

The property owner, Jack Bostock, was present. Mark Runnals, Code Enforcement Officer whose credentials are on file, entered two photographs into evidence. He displayed the photographs and explained the violations.

Ms. Vallone moved to find the property owner in violation of Section 302.7 from ordinance no. 2936 and Section 18-31 from the City’s Code of Ordinances. Second by Mr. Metrocavage. Motion carried 6-0.
Ms. Vallone moved to give the property owner 60 days for code compliance with a fine of $75.00/day thereafter. Second by Mr. Metrocavage. Motion carried 6-0.

Mr. Metrocavage moved to reduce the fine to $3,500 if paid in 60 days and to come into compliance by 9/21/2015. Second by Ms. Vallone. Mr. Grant asked for a friendly amendment to have the fine reduced to $1,500 if paid in 60 days and to come into compliance by 9/21/2015. Second by Mr. Oldham. Motion carried 5-1 (Ms. Vallone opposed).
15-031 Dorothy W. Middleton

The property owner was not present. Mr. Volker Reiss summarized the events of the case, stating that the property remains in violation and staff requests the fine be imposed.
No action was taken and the fine is imposed.
