useful and relevant papers. Also, attendance at meetings, or at least a review
of the abstract book, will help keep you plugged in to the most recent
developments. There is little worse than being challenged on the stand with
an article that you had no idea existed refuting your opinion.
You should prepare both mentally and physically for what can be very
grueling days. Even if you are a veteran, it’s useful to discuss with both your
colleagues and your attorney client the best way to present your conclusions,
and what challenges might be posed (both reasonable and unreasonable).
Moot court sessions can be useful for both an inexperienced analyst as well
as a veteran with a tough case. Classes in testimony may also be helpful for
the beginner to get tips and gain practice. Again, you are not taking a closed-
book exam. You have the resources of the whole community at your disposal.
It is prudent to take advantage of this body of knowledge and experience.
Know and understand your own personal limitations. Do you have
annoying verbal or physical habits that you must work to control? Is your
handwriting completely illegible, making it prudent to prepare exhibits ahead
of time? Do you need to establish a personal routine to control nerves? What
is your personal comfort level and what do you need to do to maximize it?
Make sure that you are well rested (easier said than done) and that you eat
properly before testimony. Someone in the courtroom will usually make sure
you have water while you are testifying, but don’t be shy about asking. There
is nothing worse than trying to be clear when your tongue is sticking to the
roof of your mouth. Last, appearance does count. Especially in front of a
jury, you should make every effort to look professional. This may mean
different things in different venues, so it pays to check out expected dress
codes with your attorney client in advance.
